  • What legal grounds may exist for debt collection?
A sum may be collected from an individual or a legal entity due to various obligations under a contract (failure to fulfill contractual obligations) or as compensation for damage caused by a tort (e.g., in the case of a car accident, damage caused by providing/not providing a service, etc.).
  • How is the state duty calculated?
The state duty for property disputes is 3% of the value of the dispute in the first instance (for a natural person, no more than 3000 GEL / for a legal entity, no more than 5000 GEL).
In the second instance, it is 4% (for a natural person, no more than 5000 GEL / for a legal entity, no more than 7000 GEL).
In the third instance, it is 5% (for a natural person, no more than 6000 GEL / for a legal entity, no more than 8000 GEL).
  • How can one file a claim with the court?
A claim can be filed with the court based on the place of performance of the contract, the defendant's location, or the court agreed upon by the parties.
  • When can provisional measures be applied to a claim?
Provisional measures can be applied both before and after the initiation of the claim.
  • What types of provisional measures can be applied to ensure a claim?
To ensure a claim provisional measures may be implemented by a court order and can include the seizure or restriction of material and immaterial goods (such as real estate, claims, vehicles, bank accounts, etc.).
  • What kind of state duty is required for requesting provisional measures on a claim?
A state duty of 50 GEL must be paid to request provisional measures (for both natural and legal persons).
  • When should one address the National Bureau of Enforcement?
The National Bureau of Enforcement should be contacted to initiate compulsory enforcement after the court's decision has entered into force and an enforcement order (writ) has been issued.
  • What amount is required to initiate compulsory enforcement?
To initiate compulsory enforcement, a state fee of 2% of the amount to be collected is required, but no less than 50 lari.
